Finding an Inspector

Generally in most transactions involving a Realtor, a purchase offer must be accepted by the Seller before the Buyer can schedule an official Home Inspection. It’s wise to shop around for an Inspector before your house search begins. Realtors typically push for an inspection to get done ASAP once the purchase offer is accepted, but Inspectors also have scheduled commitments to work around.

Should I waive an inspection?

To Waive Inspection or Not to Waive, that is the question: “Buyer beware” is a common expression that refers to the Latin phrase caveat emptor, which means “let the buyer beware”. It’s a contract law principle that places the responsibility on the buyer to inspect the property or product before making a purchase.

Here are some key points about caveat emptor:

  • Buyers, not Sellers or Realtors, are responsible for performing due diligence to ensure the product meets their needs and isn’t defective. 
  • Sellers usually have more information about the product than the buyer, so the buyer assumes the risk of defects. 
  • If a buyer doesn’t perform due diligence, they can’t necessarily recover damages if the product has defects. 

What happens if I waive an inspection?

If you waive an inspection, you might be shooting yourself in the foot. Sadly, the current real estate market is more like the wild west than it was even just a few years ago.

It is common for inspectors to find issues with poor work performed by some contractors and DIY homeowners that an untrained eye might miss. Some defects don’t get disclosed and others are not even known to the seller. 

Anything can be fixed, but at what additional cost and inconvenience?  If you do not have the knowledge to recognize latent or existing defects or the resources to correct defects discovered after you move in, then you should not waive your option to have the property inspected.
